Exemption from the obligation to pay contributions for March-May 2020.

You can apply to ZUS for exemption from paying contributions for three months – from March to May 2020. The exemption applies to contributions for social insurance, health insurance, Labour Fund, Solidarity Fund, Guaranteed Employee Benefits Fund, Bridge Pensions Fund.

Who is concerned?

  • persons performing non-agricultural activities before 1 February 2020 and paying premiums for their own insurance,
  • contribution payers who ran the company before 1 February 2020 and reported less than 10 people to social security on 29 February 2020.,
  • clergyman.

What conditions must be met to benefit from support?

  • You were engaged in non-agricultural activities before 1 February 2020 and paid premiums for your own insurance or were a payer of premiums before that date and reported less than 10 people to social security on 29 February 2020 or are a clergyman.
  • When you pay premiums exclusively for your own insurance, your income from your activity in the first month for which the application is submitted may not exceed PLN 15 681, i. e. 300% of the forecast average gross salary.
  • You must apply to ZUS by 30 June 2020.
  • You must submit your billing documents for the period March-May 2020 to 30 June 2020 unless you are exempt from submitting them under the regulations.

Companies that were in difficulty in December 2019 and did not pay their dues, including contributions collected by ZUS, will not benefit from the exemption from contributions. This is due to EU regulations. If you are active in the fisheries and aquaculture sector or in the primary production of agricultural products listed in Annex I to the Treaty on the Functioning of the European Union, please provide this information to the Social Insurance Institution. This information is important because these sectors have different thresholds for permissible state aid. If they are exceeded, public aid may have to be repaid.

What you gain?

  • Exemption from the obligation to pay contributions for the period March-May 2020, known as at the date of application processing.  
  • The legislation does not provide for a minimum and maximum amount of contributions which may be covered by the exemption, except for non-agricultural businesses and their collaborators and clergymen, for whom it only covers contributions from the lowest basis of assessment.

How to apply?

  • In order to obtain exemption from the obligation to pay contributions you must submit an application to ZUS for exemption from the obligation to pay contributions (RDZ).
  • You may submit a request:
  • electronically by PUE ZUS
  • electronically via PUE ZUS, via the gov.pl website
  • via post,
  • personally in a ZUS facility – to a document box (without contact with a ZUS employee)
  • The electronic application must be accompanied by the information required by the European Commission in relation to the public aid granted (Communication 2020/C 91 I/01) – Annex to the RDZ application

  • If we have any doubts about the application, we will contact you by e-mail or telephone.
  • You will receive information from us about the settlement on PUE ZUS or we will send it by post.. 

Can you appeal?

  • If you do not agree with the decision refusing to exempt you from paying contributions, you can apply to the President of ZUS to reconsider the case. All you have to do is to submit a letter to the Social Insurance Institution. You have 14 days from the date of delivery of the decision.
