Idle time benefit for persons performing civil law contracts

If you have entered into a civil law contract and the contract has not been concluded or there has been a limitation of its performance due to business interruption following COVID-19, you will apply to ZUS through your principal or ordering party for a one-off financial benefit to compensate you for the loss of revenue.

For whom?

Persons performing a civil law contract (agency contract, contract of mandate, other contract for the provision of services, to which, in accordance with the Civil Code, the provisions concerning the mandate, contract of work apply).

What conditions do you have to meet to receive support?

• You perform a civil law contract concluded before 1 February 2020.
• If the sum of your income from civil law contracts in the month preceding the month in which you applied for a parking benefit is up to PLN 1,299. 99 (less than 50% of the minimum remuneration for work in 2020), you are entitled to a idle time benefit in the amount of the sum of remuneration from these contracts.
• Your income from a civil law contract obtained in the month preceding the month in which you applied for a parking benefit did not exceed the amount calculated as 300% of the average monthly salary from the previous quarter announced by the President of the CSO on the basis of the regulations on pensions from the Social Insurance Institution (FUS) in force on the day the application was submitted.
• You have no other title to social security.
• You live on the territory of Poland and are a citizen of the Republic of Poland or have the right of temporary or permanent residence on the territory of Poland.
• You cannot perform a civil law contract in whole or in part due to business downtime.

What you gain?

• You will receive funds to compensate for the loss of revenue.
• You can get 2080 PLN. However, if the sum of your income from civil law contracts in the month preceding the month in which you applied for a parking benefit is up to PLN 1299. 99 (less than 50% of the minimum remuneration for work in 2020), you are entitled to a idle time benefit in the amount of the total remuneration from these contracts.
• You will receive a one-time withdrawal to your bank account.

How to apply?

• In order for you to receive a idle time benefit your employer or ordering party must apply to ZUS for a parking benefit (RSP-C).
• The principal or ordering party must receive your statements that you are not subject to social security on other grounds and about the amount of income from other contracts.
• If you have concluded more than 1 civil law contract, each principal or ordering party applies separately for each contract.

• Applications for benefit can be submitted to ZUS at the latest within 3 months from the month in which the declared state of epidemic was lifted.
• Your principal or ordering party may submit a request:
  • electronically by PUE ZUS
  • electronically via PUE ZUS, via the gov.pl website
  • via post,
  • personally in a ZUS facility – to a document box (without contact with a ZUS employee)
• The application must be accompanied by a copy of the civil law contract.

How will we contact you?

• If we have any doubts about the application, we will contact you by e-mail or telephone.
• If your application is successful, you will receive a benefit on account of.
• You will have a decision refusing the benefit at PUE ZUS or we will send it by post. 

Can you appeal against the decision?

• If you do not agree with the decision to refuse the idle time benefit, you can appeal to the court (according to the rules of the Code of Civil Procedure), through ZUS. You shall submit your appeal in writing within one month of receiving the decision.
